1. ACCEPTANCE AND OWNERSHIP
This User License Agreement (the "Agreement") governs the relationship between you (the "Licensee") and Cutout|trees (the "Licensor") with respect to the digital images and CAD files obtained through https://www.cutout-trees.com (the "Files"). By downloading any File, you accept these terms. If you do not accept them, do not download or use the Files.
The Files are licensed, not sold. All Files, together with the Cutout|trees name and brand, remain the exclusive property of the Licensor and are protected under international copyright law, including the Berne Convention for the Protection of Literary and Artistic Works. Subject to your compliance with this Agreement, the Licensor grants you a non-exclusive, perpetual, worldwide, non-transferable license to use the Files. No ownership or intellectual property right in the Files passes to you.
2. PERMITTED AND PROHIBITED USE
You may use the Files in your professional work — including architectural visualizations, design, and illustration — and you may modify them as a project requires. You may incorporate the Files into the projects and deliverables you produce for your own clients; the resulting work is yours to deliver.
What you may not do is part with the Files themselves. You may not redistribute, resell, sublicense, lease, or otherwise make the Files available to any third party, in their original or modified form, whether for payment or free of charge. This includes uploading them to file-sharing services, peer-to-peer networks, third-party-accessible cloud storage, asset libraries, or any other medium from which others could obtain them. Nor may you offer any product or file whose value consists, in substance, of the Files themselves.
3. TERMINATION
This Agreement remains in force for as long as you hold or use the Files. The Licensor may terminate it immediately, and without notice, upon any breach of its terms. On termination you must stop using the Files and delete every copy in your possession or control. Termination does not waive any right or remedy otherwise available to the Licensor. Refunds are governed by our Refund Policy.
4. DISTRIBUTION AND ENFORCEMENT
https://www.cutout-trees.com is the only authorized source for Cutout|trees Files. Any copy offered or found elsewhere, in original or modified form, is unauthorized and infringes the Licensor's rights.
The Licensor monitors distribution channels and enforces its rights without prior warning. Where infringement is found, the Licensor pursues every remedy available to it. These include takedown under the Digital Millennium Copyright Act (DMCA), which obliges the hosting platform to remove the infringing material and can lead to suspension of the account responsible; the direct liability of online platforms for unauthorized distribution under Article 17 of the EU Copyright Directive; and civil proceedings for damages, costs, and injunctive relief against the individuals and the platforms involved.
By downloading and using the Files, you acknowledge the Licensor's exclusive ownership and agree to be bound by this Agreement.
